Restoration Terms and Agreement Example

Restoration Agreement EXAMPLE

Thank you for choosing KMA Restoration, LLC for the restoration of your collectible automobile.

To provide guidance and insight to the process and procedures of restoring vehicles for our customers, the following policies have been developed to minimize ambiguities. It is our desire that this process will be enjoyable and satisfying for both parties.

  1. Because of the comprehensive nature of the restoration process, a finalized estimated total cost cannot be given at any time.
    • We can, and will provide estimates prior to working on your vehicle, however, these estimates may not fully reflect the scope of the project. There may be additional labor, parts or materials needed that the initial estimate did not detail (e.i. rust that was not visible from the surface, but is found once the vehicle is being disassembled for the work originally agreed upon). It is most important that this be understood and accepted.
    • We will communicate any additional time, material, or parts that will be needed to continue work on your vehicle as they arise. This is so that you may make the best, and most informed decisions throughout the restoration process.
  1. A $5,775 deposit, roughly equivalent to two weeks labor (77 hours at our shop rate of $75.00 per hour) is required prior to, or at the time of the vehicle arriving at KMA Restoration.
    • This deposit will be applied to work performed, parts required, and materials consumed until the initial deposit is depleted. Additional deposits will be required when the original deposit is worked down to $500 or less. This system of placing deposits will be used throughout the course of the restoration.
  2. Invoices reflecting work performed and the amount of your deposit used will be sent monthly, mailed within the first week of the month.
  3. In the event of a balance due on your account, any and all work on your vehicle will be halted and placed on “hold” until the next deposit is received.
    • In the event of hold, a $200 per month storage fee will be accrued until the next agreed upon deposit is received.
    • Vehicles must be picked up within 7 days of completion, unless otherwise agreed upon. After 7 days, a storage charge of $45 per day will be charged.
  4.  Invoices will include a charge titled “Time and Materials” and “Body Supplies”
    • For the sake of transparency, time spent on your vehicle will be documented by a time clock and a list of parts and paint materials used within the billing cycle will also be included on the invoice.
    • “Body Supplies” includes materials directly related to the work completed on your vehicle, but they will not be included in an itemized list on your invoice. These materials include, but are not limited to – guide coat, cleaning solvents, HazMat costs etc.
      • This cost will be $38 per hour of body time attributed to the restoration. Additional information regarding the specific materials used will be provided upon request.
    • All parts, materials, and sublet work will be marked up at a rate of 30% to cover transportation and administrative costs.
  5. If an offsite estimate is required, a charge will be applied to cover time, and travel costs.
  6. Any and all rust repair is not subject to be warrantied.
  7. Insurance on the vehicle while in possession of KMA Restoration, LLC is the responsibility of the vehicle owner.
  8. The customer may at any time remove the vehicle upon payment of all outstanding invoices. Vehicles are not released until all account balances are paid in full.
